Build Your Brand Immersion™ — Terms & Conditions
Last Updated on 21 Sept 2026 .
These Terms & Conditions govern enrolment in and participation in the Build Your Brand Immersion™ (the “Program”), delivered by Cassandra Emmerson trading as Emmersyn Brand Consultancy (“Emmersyn”, “we”, “us”, “Cassandra”). By signing up to the Program, paying a deposit or instalment, accessing the portal, or attending a session, you (“the Client”, “you”) agree to be bound by these Terms.
1. The Nature of the Program
- The Build Your Brand Immersion™ is a guided, done-with-you brand-building program for service-based founders, based on The Brand Way™ methodology and working through the four pillars of Purpose, Positioning, Personality and Picture.
- The Program includes live three-hour building sessions, four (4) one-hour open office sessions, fourteen (14) pre-recorded education modules, a dedicated Notion page for the Client’s brand, and the Brand Strategy Canva template.
- The Program runs over 4 weeks. Each Client has an access window of up to two (2) months from their start date (the “Term”) to complete eight (8) live building sessions and four (4) open office sessions.
- The Program is a one-off enrolment for the full Term and ends automatically when the Term closes.
- The Program is capped at ten (10) founders at any one time and is designed for founders with an established business, existing customers and market evidence to build from. Emmersyn may recommend a different program where a founder is at an earlier stage.
- Access to sessions, the portal, the Notion page, the community space and all Program materials is personal to the enrolled founder for the duration of the Term, and ends when the Term closes unless separately agreed in writing.
2. Investment & Payment Terms
- The total investment for the Program is AUD $4,400 including GST when paid in full, or AUD $4,704 including GST when paid by payment plan (the “Total Investment”), as selected by the Client at signup.
- Where the Client selects the payment plan of twelve (12) weekly payments of $392, each instalment is a scheduled part-payment of the fixed Total Investment, which is incurred in full upon enrolment.
- By enrolling, the Client accepts liability for the full Total Investment, regardless of the payment option chosen, their attendance or participation, or a later change of mind. A payment plan spreads the timing of payment and leaves this liability unchanged.
- All payments are due on the dates set out at signup, and the Client is responsible for maintaining sufficient funds and valid payment details until the Total Investment is paid in full.
- Program pricing may change for future intakes. The price confirmed at signup applies to the Client’s enrolment.
3. Missed or Defaulted Payments
- If a scheduled payment fails, is declined, or is not received by its due date, the Client’s access to sessions, the portal and all related materials will be paused until the outstanding payment is rectified.
- Emmersyn will make reasonable attempts to notify the Client of a failed payment before pausing access. Continued non-payment beyond a reasonable period may result in suspension or termination of the Client’s place in the Program, and amounts already paid will be retained.
- A pause in access due to non-payment leaves the Client’s liability for the remaining instalments in place and does not extend the Term.
- Where a payment remains outstanding, Emmersyn reserves the right to recover the unpaid balance, together with any reasonable costs of recovery, by any lawful means.
4. Refunds, Change of Mind & Deferral
- Upon enrolment the Client receives immediate access to the portal, pre-recorded modules, prework and proprietary Materials. For this reason, all payments are non-refundable for change of mind, including where the Client chooses to stop attending or does not complete the Program.
- Where the Client is unable to continue due to serious illness, bereavement or another significant personal circumstance, they may request in writing to defer their remaining sessions to a later intake. Deferrals are at Emmersyn’s discretion, may be granted once, and must be used within six (6) months of the original start date.
- A Client’s place in the Program is personal and may not be transferred to another person or business without Emmersyn’s written consent.
- Nothing in these Terms excludes any right or remedy the Client has under the Australian Consumer Law that cannot lawfully be excluded.
5. Sessions, Prework & Missed Sessions
- Live building sessions run on a rotating fortnightly cycle through all four pillars on Tuesdays and Thursdays from 10am to 1pm AWST, with open office sessions on Wednesdays from 11am to 12pm AWST. Session dates are published in the portal.
- Each session has set prework, including the relevant pre-recorded module. The Client is expected to complete the prework before attending, as the live sessions are where the building happens and they rely on the Client arriving prepared.
- Where the Client misses a session, they may join the same pillar session in the next fortnightly rotation within their Term, or catch up using the session recording or transcript. Private or one-on-one make-up sessions are outside the scope of the Program.
- Sessions, office support hours and access not used by the end of the Term expire and cannot be carried forward, credited or refunded.
- Emmersyn may occasionally need to reschedule a session due to illness or unavoidable circumstances and will offer the next available rotation or a recording in its place.
6. Results & Liability
The Build Your Brand Immersion™ is a guided education and brand-building program. Cassandra provides the methodology, facilitation, questioning, ideas and synthesis, and the Client is responsible for doing the work and implementing their brand.
- Emmersyn makes no guarantee or warranty of any specific business outcome, including revenue, sales, leads, bookings, engagement or growth, arising from the Client’s use of, or failure to use, any strategy, direction or Material provided in the Program.
- Results referenced in Program marketing, case studies or testimonials reflect individual client experiences and represent what those founders achieved.
- To the maximum extent permitted by law, Emmersyn’s liability arising from the Program is limited to the amount actually paid by the Client under these Terms. Nothing in this clause excludes any guarantee, right or remedy that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law.
- To the extent permitted by law, Emmersyn excludes all liability for loss of profit, goodwill, business opportunity or anticipated savings, and for any indirect or consequential loss arising from the Program.
- The Client agrees to reimburse Emmersyn for any liability, including reasonable legal costs, incurred in connection with a third-party claim arising from the Client’s breach of these Terms.
7. Intellectual Property
The Brand Way™ methodology, the Build Your Brand Immersion™ program structure, and all associated frameworks, questions, session content, pre-recorded modules, prework, the Brand Strategy Canva template, Notion pages, worksheets, portal content, recordings, transcripts and strategic ideas shared with the Client (collectively, the “Materials”) are the original intellectual property of Cassandra Emmerson / Emmersyn Brand Consultancy.
- Enrolment grants the Client a personal, non-transferable, non-exclusive licence to use the Materials solely to build the Client’s own brand. Ownership of the Materials remains with Emmersyn at all times.
- The Client owns the brand they build, including their own brand strategy outputs, words and decisions created for their own business during the Program.
- The Client may not copy, screenshot, record, reproduce, republish, distribute, resell, teach, adapt, white-label or otherwise share the Materials, or any version or derivative of them, with any third party, including the Client’s own clients, students, team, business partners or the public.
- The Materials may be used only for the Client’s own brand and business. They may not be used, in whole or in part, to build, deliver, coach, consult on, or create brand work for any other business, brand or client, whether paid or unpaid.
- These intellectual property obligations survive the end of the Term and continue indefinitely.
8. Confidentiality, Recordings & Sharing Wins
- Live sessions are group sessions. The Client agrees to keep everything other founders share in sessions, office hours and the community space confidential, and to use it for no purpose outside the Program.
- Sessions are recorded and transcribed so founders can catch up and revisit their work. Recordings and transcripts form part of the Materials, are for the Client’s personal use during the Term, and may be used by Emmersyn internally, including for program improvement and training purposes.
- The Client agrees that Emmersyn may share the Client’s wins, progress and the general nature of their brand journey when marketing Emmersyn’s services, including as a case study, testimonial or example of results, provided this does not disclose the Client’s confidential information.
- Any testimonial, case study, image or recording that identifies the Client by name, face, brand or figures will only be used with the Client’s consent.
- Emmersyn and the Client each agree to comply with the Privacy Act 1988 (Cth) so far as it is relevant. Emmersyn may store Program files and communications in its ordinary IT systems, including cloud and third-party platforms, and is not liable for loss or disruption caused by a third-party platform except where the law makes it liable.
9. Community Conduct
- The Program is a space of trust, openness and generosity, and every founder is expected to engage with respect, kindness and professionalism in sessions and the community space.
- Promotion, solicitation of other founders for the Client’s own services, or conduct that is abusive, discriminatory or disruptive falls outside these expectations.
- Emmersyn reserves the right to remove a Client from the Program where their conduct breaches this clause, in which case amounts already paid will be retained and any outstanding balance remains payable.
10. General
- These Terms, together with the signup documentation and any Client Agreement, form the entire agreement between the Client and Emmersyn in relation to the Program, and supersede any prior understanding or verbal agreement.
- Emmersyn may update session times, formats or minor program logistics to suit the needs of the cohort, provided the overall scope and value of the Program is maintained.
- Neither party is liable for delay or failure to meet an obligation under these Terms, other than an obligation to pay, to the extent it is caused by an event beyond their reasonable control.
- These Terms are governed by the laws of Western Australia, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Western Australia, regardless of where the Client is based.
- Any variation to these Terms must be agreed in writing between the Client and Cassandra Emmerson.
